The DMV is a tribunal hearing. What happens is that you’re in an office, a private office with the DMV hearing officer. That person is not a lawyer, but that person is appointed to make decisions about your ability to drive. Prior to the DMV hearing, your lawyer is given a copy of the evidence that they intend to rely upon. Normally it’s a paper work hearing, meaning that the DMV relies upon the arrest report and the documentary evidence filed by the arresting agency in your case, that means the paper work is very important. If the paper work is not in order, or if there are important documents that are absent, you can win a DMV hearing and avoid a license suspension that way. You do have the opportunity to present evidence either to testify yourself about the facts of your case or to have witnesses testify for you. Sometimes it’s important to have a toxicologist testify about your breath or blood alcohol levels, the police procedure and whether the DMV could establish you were over the limit at the time of driving. It’s an informal hearing, but the hearing can take up to one to two hours.
