New Vehicle Code Sections for DUI

The 2014 California Vehicle Code amends the code sections for DUI. Previously, Vehicle Code Section 23152(a) made it an offense to drive under the influence of alcohol or drugs or under the combined influence of alcohol or drugs. It was often necessary to motion to strike the reference to drugs in the criminal complaint, when the facts supported only DUI based on alcohol.

The new Vehicle Code amends Vehicle Code section 23152(a) to make it an offense to drive under the influence of alcohol only. The new Vehicle Code section 23152(e) now makes it an offense to drive under the influence of drugs alone and section 23152(f) makes it an offense to drive under the combined influence of alcohol and drugs.

These changes do not alter the penalties for DUI. The changes were operative January 1st 2014.
