David Cassidy Arrested for DUI in Los Angeles

David Cassidy is the latest celebrity to be arrested for a DUI in Los Angeles. According to media reports, the 63 year old Seventies Star was pulled over last Friday night by the CHP near LAX for allegedly making an illegal right turn at a red traffic light.

He was released on $15,000 bail after providing a breath sample with a reading of .19%. This is over twice the legal limit of .08%. Driving with a .15% breath or blood alcohol level is an enhancement in the California Vehicle Code that requires the court to consider greater penalties.

According to media reports, Mr. Cassidy has been arrested for DUI twice before. He has a DUI conviction in Florida from 2011 and has another DUI case pending in New York.

If convicted of a third DUI in Los Angeles, the minimum penalties would include a mandatory 120 days in county jail and a three year license revocation. Out of State convictions can be alleged as priors in the State of California. At present, Mr. Cassidy would be facing prosecution as a second offender as his case in New York is yet to be concluded. The minimum penalty for a second offense includes 96 hours of county jail, but up to a maximum of one year in county jail.

According to Mr. Cassidy's agent, he will be entering a program of rehabilitation to address issues with alcohol. The Judge that eventually deals with Mr. Cassidy's case does have the discretion to give day for day credit for time spent in a residential treatment facility against any jail sentence.
