Michael Phelps Arrested for DUI

Michael Phelps was arrested earlier today for DUI. According to NBC4 news reports, Phelps was stopped by the police in Maryland for driving at 84mph in a 45mph zone.

He was allegedly impaired to drive and arrested for DUI. This is Mr. Phelps second arrest for DUI. He pled guilty to DUI when he was 19 and was placed on 18 months of probation. Michael Phelps has won 22 Olympic medals, the most of any Olympian.

In California, a conviction for DUI with a high-speed enhancement carries a minimum of sixty days in county jail. A high-speed enhancement requires the prosecution to prove that the defendant was guilty of DUI and was traveling in excess of 20 miles per hour over the speed limit on a street or 30 miles per hour over the speed limit on a freeway. In addition, the prosecution must prove reckless driving.
