What Does CA Law Say About DUI Causing Injury?
The California law detailing DUI offenses involving injury to another party can be found in § 23153 of the California Vehicle Code.
According to this statute:
(a) It is unlawful for a person, while under the influence of any alcoholic beverage to drive a vehicle and concurrently do any act forbidden by law, or neglect any duty imposed by law in driving the vehicle, which act or neglect proximately causes bodily injury to any person other than the driver.
You can be charged with DUI causing injury if your BAC registered at 0.08 or higher, regardless of whether or not your ability to drive was impaired.
Commercial drivers can also be charged under § 23153 if they caused an accident resulting in the injury with a blood alcohol content at or above 0.04 percent.
