Second DUI for Bobby Brown

Bobby Brown is facing prosecution for a second DUI in Los Angeles. According to media reports, Mr. Brown is on $25000 bail following a recent DUI arrest in Tarzana. He is currently on probation for a DUI following his arrest in the San Fernando Valley earlier this year. He refused to submit to a chemical test which can result in a longer license suspension and additional jail time if convicted of DUI. To make matters worse, he was also reportedly driving without a DMV mandated ignition interlock device in his vehicle. A DUI conviction in Los Angeles leads to a DMV requirement that the defendant install in his or her vehicle an ignition interlock device. This requires the driver to blow into it with alcohol-free breath before the car will start.

A second DUI in California carries a minimum of 96 hours in county jail and a maximum of one year in county jail. A refusal enhancement requires an additional two days in jail. A probation violation for a first offense carries a minimum penalty of no jail time, but a maximum of six months. This means that Bobby Brown is facing a maximum of eighteen months in county jail.
